The Crofting Commission is responsible for regulating the crofting system and promoting the interests of crofting to ensure its future sustainability. This new role will sit within the Legal and Regulatory Support Team which is primarily responsible for proving legal advice and guidance to the wider Commission dealing with appeals against Commission decisions to the Scottish Land Court administering the Commissions scheme of Delegation decision making preparing responses to complex casework and procedural queries issuing procedural guidance and preparing materials and delivery training to both Commission and SGRPID staff.

The Crofting Regulatory Support Officer is a new role within the Commission and will include supporting the Commission solicitor and other team members in undertaking the tasks associated with the implementation of the Crofting and Land Court Bill currently going through parliament with a particular emphasis on the changes which will impact upon the Commissions Duties Enforcement processes and related applications/notifications liaising with colleagues from the Commissions Residence and Land Use Team (RALUT) who are the team responsible for duties enforcement. This will involve participating in identifying and implementing the changes required to our current forms associated documentation procedures guidance etc to deliver the changes brought in by the new Bill. The role will also involve participating in the delegated decision making process; drafting grounds for complex casework decisions; and providing support to the solicitor and other team members in the range of tasks involved in providing legal and regulatory support to the wider Commission. The role will require the postholder to hold a good knowledge of crofting legislation and have experience of the Commissions casework processes and procedures.

  • Take the lead in the implementation of those changes introduced by the new Crofting Bill which will directly impact upon the Commissions Duties enforcement processes and associated applications requiring changes to workflows; forms; letters and other supporting documentation; guidance workflows etc.
  • Keep under review and update the content of the Commissions published Law Policy and Procedure documents relating to Duties Enforcement processes to reflect legislative and policy changes.
  • Participate in the implementation of those changes introduced by the new Crofting Bill which will impact upon the Commissions Regulatory application and notification casework processes requiring changes to workflows; forms; letters and other supporting documentation; guidance etc.
  • Participate in and draft grounds for complex casework decisions as part of the Commissions Scheme of Delegated decision making.
  • Provide administrative support to the Commission solicitor as required with particular focus on matters relating to the new Crofting Bill.
  • Provide support to other team members in responding to queries on complex casework and procedural matters
  • Participate in the preparation of training materials and the delivery of training to Commission and SGRPID colleagues.
  • It is anticipated that once the tasks related to the changes to the new Crofting Bill are implemented that part of the duties of the post will be to take on tasks relating to processing Duties Enforcement casework as part of the Commissions Residence and Land Use Team (RALUT).
